Work-related injuries can raise many questions. For example, you might ask: Can I recover fully? Is my job in jeopardy? How will I pay my bills while I can’t work? The workers’ compensation system is in place to protect individuals injured on the job. However, understanding there are benefits available is one thing. Knowing how they might help your case is another. Percentage of disability The New York Workers’ Compensation Board has a specific formula for determining benefits. This may include factors such as whether your condition is temporary or permanent. When you first become injured, the Board may consider your disability temporary. Injuries leading to a partial permanent disability would be paid according to the state’s Schedule Loss of Use (SLU). Hearing Eyesight Extremity Brain, spine, heart, lung and pelvic injuries are permanent conditions and do not relate to the SLU, according to the Board. They would qualify you for benefits according to a different schedule. Meanwhile, face, head and neck disfigurement may entitle you to receive additional compensation. Maximum weekly benefits Keeping the above in mind, you should also understand that there is a maximum amount of workers’ compensation you can receive each week. This amount is adjusted each July. If you were injured on or after July 1, 2021, the most you could anticipate receiving per week is $1,063.05. Your maximum for injuries sustained during the previous fiscal year is $966.78. Optimal results Job-related injuries are often complex and emotionally taxing in addition to physically painful. And financial demands continue, despite your ability to earn an income. Although the amount of benefits you receive must meet specific criteria, you must protect your interests. So you’ve been injured at work and are now struggling to figure out how to make ends meet. It’s not an easy task. After all, your medical expenses and rehabilitation costs continue to accumulate at a time when you either don’t have or have run out of paid time off. This can leave you in a dire predicament, but one that can be alleviated by workers’ compensation benefits if you qualify. Sounds easy, right? Well, the sad reality is that many initial workers’ compensation claims are denied. This can occur for a variety of reasons, including lack of medical evidence and evidence that the injury pre-dated the workplace accident. Fortunately, even if your claim was denied on the first go-round you can take another shot at recovering the benefits you need and deserve. This comes in the form of an appeal. There are many appellate steps, which include, in order: Administrative review of the denied claim whereby three members of the Workers’ Compensation Board review and usually affirm, rescind, or modify the initial determination. In some instances, this stage allows for you to present additional evidence. Review of the claim by the entire Workers’ Compensation Board. This is discretionary, meaning that the full Board doesn’t have to review your case. If they do, though, they will either affirm, rescind, or deny the initial determination. Review by the appellate court system. At each stage of the appellate process, you might have the opportunity to present additional evidence and/or legal arguments to support your position. This means that you need to be armed with the facts, records, and legal knowledge necessary to present your case in a persuasive fashion. Workers compensation can be an important lifeline for injured workers facing time away from work with no paycheck and mounting medical bills associated with the workplace injury they have suffered following a workplace accident. Fortunately, New York workers’ compensation benefits protect injured workers in those situations. Workers injured on the job in New York can recover different types of workers’ compensation benefits to help them with the different, specific, needs they face in the wake of a workplace accident. Workers’ compensation benefits include: Medical benefits – injured workers can receive benefits to help them with the medical expenses associated with the treatment and care they need for their injury. Wage replacement benefits – injured workers can receive benefits to help them with their lost wages and earnings while they are away from work recovering from their injury. Wage replacement benefits are commonly two-thirds of the worker’s average weekly income. Vocational rehabilitation – if the injured worker is unable to return to the work they did prior to the injury they suffered, vocational rehabilitation benefits may also be available to them through workers’ compensation. Employers in New York are required to carry workers’ compensation insurance in mot situations to help injured workers and their families if they are hurt on the job. There are timelines associated with a workers’ compensation claim for benefits that injured workers and their families should be aware of. Injured workers have 30 days following the injury to report it to their employer and 2 years in most cases to make a claim for workers’ compensation benefits. Workers’ compensation benefits may be available to injured workers who have suffered a workplace injury or are suffering from an occupational illness related to the work they have done.
